in 1988 to address this class of merchants and at the same time <br />stated the already existing implicit requirement that such types <br />of sales could only be from commercially zoned properties. <br />At the time of the definition the issue of what constituted a <br />transient merchant as opposed to a non-translent merchant was <br />left unaddressed. To the extent however, that a person who is <br />merchandising from a location at more than an infrequent basis is <br />intensifying the land use of that location. To the extent It <br />becomes a perennial business it is causing an intensification of <br />thf, land use without an appropriate land use review. Such a <br />commercial site plan or zoning review would look at issues as far <br />as setbacks, minimum building sizes, traffic flows, structure <br />reviews, parking, etc. which become part and parcel of any <br />substantial change in a commercial site use. <br />In order to address this land use concern which translates into <br />issues of public health, safety and welfare a possible strategy <br />would be: <br />A. Define transient merchants as those persons <br />conducting business for no more than a certain number of <br />days or occasions per year. Variations on this could <br />include actual number of days operated, a specific block <br />of time that would be allowed, etc. <br />B. Specifically state that in the solication ordinance <br />and possibly land use that all other merchandising that <br />did not qualify as transient merchants, business or <br />contribution solicitation would be required to be <br />conducted in a permanent structure in accordance with <br />the applicable land use regulations. (There may need to <br />be a "fine tuning" of bi’siness and contribution <br />solicitation definitions.) <br />ALTERNATIVES - <br />Policy <br />A. Regulate as at present. <br />B. Require less regulation. <br />C. Defer discussion. <br />D. Define the terms of what constitutes transient <br />merchants, <br />E. Explore an Increased fee such as a vendor fee <br />(currently the City does not license businesses <br />generally .) <br />F. Explore other alternatives (see eurvey).
