Existing and proposed hardcover is as follows: <br />0-75*: <br />75-250': <br />Allowed <br />0 <br />35% (3421 sf) <br />Existing <br />2.0 <br />40.5% (3950 sf) <br />Proposed <br />2.3% (133 sf) <br />42.7% (4170 sf) <br />Discussion - <br />This property is another prime example of the "expanding <br />hardcover syndrome", in which the intentions of the City have not <br />been fulfilled. Although the current applicants had nothing to <br />do with the existing hardcover situation, creating additional <br />hardcover on the property would seem to be questionable. <br />The apparent reason why hardcover currently exceeds 35% is <br />because the driveway was constructed significantly wider than it <br />should have been. This would seem a logical area in which hard­ <br />cover removals might be considered. <br />The existing deck is not the shape of that originally <br />proposed, but approximates the approved square footage. While <br />the existing deck meets both the 75' setback and the average <br />lakeshore setback, the proposed patio will extend approximately <br />8' lakeward from the 75' line. The proposed patio area will be <br />below grade, and applicants propose some sort of a french drain <br />system to handle any run-off into it. Perhaps some sort of pump <br />system will be needed. Applicants should seek competent advice <br />on this matter. <br />The City has denied many requests for excavation in the 0- <br />75' zone to create walkouts in recent years. Does this proposed <br />excavated patio area fall into the same category, or is the fact <br />that it will not be fully excavated to allow a gravity run-off <br />situation but be contained by a surrounding retaining wall, make <br />this a unique case? <br />Staff Reconmendation - <br />riease review the attached exhibits, and if possible view <br />the site. If Planning Commission feels that the proposed <br />hardcover increase is justified by a hardship or unique <br />circumstances, then a recommendation for approval might be <br />appropriate. Planning Commission may wish to consider removals <br />of portions of the driveway to reduce the hardcover back to a <br />level more consistent with the previous approvals. Planning <br />Commission may also wish to ask the applicants to revise their <br />plans to avoid any grading work, construction, or retaining walls <br />within the 0-75' zone.
