The City Council finds that the conditions existina on this property are peculiar to <br /> it and do not apply `ez�erally to other property in this zoning district; that arantin� <br /> the variance would not adversely affect traffic conditions, li�ht, air nor pose a fire <br /> hazard or other danger to nei�11L�OTlIltr property; would IlOt merely serve as a <br /> convenience to the applicants, but is necessaiy to alleviate a denionstrable <br /> hardship oi� difficulty; is necessary to preseiti�e a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the Zonin� Code <br /> and Comprere.nsive Pi_an of the Cit;T. <br /> CONCLLJSIONS, ORDER AND CONDITIONS <br /> Based u�on one or more of the above findin�s, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zonina Code Section 78-1279 to allow construction of a new <br /> lakeside deck to be located 52.9' from the OHWL vvhere a 7�' setbacl: is noinlally required and <br /> a ��n�i-1��c�^ t � Orono Municipal Zonin� Code Section 7�-1288 to allo�v hardcover within the 0- <br /> %�'zone ot �03 s.r. ar �% where 1,234 s.f. or 7% currently exists and v io is nonnally allowed <br /> and witlun the 7�'-2�0' zone of 9,949 s.f. or 31.5% where 10,037 s.f. or 32% cuizently exists and <br /> 25 io is iioiii�ally allow•ed in order to construct a rlew• rear stoop ai�d lal:eside decic, �ubject to the <br /> following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants and annotated by <br /> City staff, attached to this Resolution as E�hibit B. Any amendinents to tlie site plan <br /> which are not in conformity with City codes will require further Plannin; Conunission <br /> and Citv Council review. <br /> ?. riardcover in the 0-75' zone shall not :nc�ease �bo��e tl.e level of 903 s.f. or 5°%. <br /> Hardcover in the 75-250' zone shall be limited to 9,949 s.f. or 31.�% per the proposed <br /> plan and hardcover allo�vance summary as depicted on Eahibit B. Applicants are advised <br /> that an�� future requests to increase hardcover or chan�e the nature of existing/appro��ed <br /> hardcover shall require City approval, and increases in hardcover ��-i11 not lil:ely be <br /> approved ��itl�out coilcun��nt reduction in e:�isting hardcover. <br /> 3. Applicants shall remove ali plastic or tabric liner material from the decorative landscape <br /> beds on the property to ensure their permeability as non-hardcover surfaces. <br /> 4.
