li* <br />Cltv of ORONO <br />CITY <br />OF <br />ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.2763 <br />D)test other areas of the property to install some <br />type cf system suitable and acceptable to the City <br />which would, although perhaps not totally meeting code <br />standards, at least not result in a potential for <br />contamination of neighboring wells or disturbance of <br />neighboring properties. <br />3.Prior to issuance of a building permit, the applicant <br />shall sign a formal waiver of assessment appeal rights for <br />the reasonable share of costs to provide municipal sewer to <br />the property as part of any forthcoming sewer project. <br />4.The Council is approving this variance based upon the <br />applicant's control and eventual fee ownership of both Lots <br />4 and 5.A condition of this variance is that at such time <br />that applicant is fee owner of Lots 4 and 5, such lots shall <br />be legally combined for tax purposes. The current fee <br />owners of each lot,in signing and agreeing to the terms of <br />this resolution, acknowledge the City's intent that the lots <br />be combined, and the owner of Lot 4 is placed on notice that <br />should such combination not occur, the City is under no <br />obligation to allow separate residential use of Lot 4. <br />5.The structure on Lot 4 shall remain merely as a storage <br />building, shall not be provided with plumbing, and shall not <br />serve as a second dwelling unit on the property. <br />6.Based upon the lot combination, ap{.licant and the fee <br />owners are advised that it is the City's intent to not <br />assign a sewer unit assessment to Lot 4, since the structure <br />on Lot 4 has no plumbing and is intended to serve as a <br />storage structure accessory to the principal structure on <br />Lot 5. <br />7.Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive only ar ' <br />must be exercised by application for a building permit <br />within one year of the date of Council approval, or this <br />variance will expire on that date (February 26, 1991). <br />8.Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the zoning code, shall automatically terminate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />Page 4 of 6
