The wood play structure located near the 168 s.f. patio will not <br />encroach on any lake views enjoyed by neighbors. <br />6. The City Council has considered this application including the <br />findings and recommondatlono cf the Planning Conaiisaion. reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variance on the health, safety and welfare of the cocasunity. <br />7. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this soning district; that granting the variance would not <br />adversely affect traffic conditiona, light, air nor pose a fire haxard <br />or other danger to neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon <br />strable hards.hip or difficulty; io necessary to preserve a substantial <br />property right of tho applicant; and would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />COIK1.081CMS, <»o&v Ai?i '*mui nam <br />Based upon ’.ns or more of the findings noted above, the Orono <br />City Council hereby grants a variance per Municipal toning Code Section <br />10.22, Subdivision 1 4 2 to penait the construction of a aecood story deck <br />which encroaches 12* into the average lakeshore setback sene where so <br />encroachment is normally allowed, and which results in a net decrease in <br />hardcover in the 75-250* lakeshore setback tone from 45,11 existing to <br />44.61 where only 251 hardcover is normally allowed, subject to the <br />following conditional <br />1. Applicant shall remove 168 s.f. of hardcover contained within the <br />block patio located at the southerly corner of the house (see Exhibit <br />A attached). Applicant ahall also remove 277 s.f. of patio blocks <br />adjacent to and not under the proposed deck.
