Lawrence Kane <br />3850 Barrett Creek Road <br />Golden Valley, MN 55427 <br />Retv.^97 Casco Point Road, Orono <br />Dear Mr. Kane: <br />We were called to your Casco Point address this morning to <br />inspect some fence work apparently being installed by Richard <br />Lorge on ^t 3. The fence appears to be a 42" high wood board <br />fence. If so, it would conform to the requirements of Orono's <br />current zoning code section 31.433. This is true even where <br />It runs down the bank to the lake and where it is close to <br />your house on Lot 4. <br />^ position to guarantee that the fence is located <br />Lot 3. It would b2 up to each neighbor to be sure it <br />does not encroach onto yc»::r adjoining lots except with your <br />permission. <br />The main purpose of this letter, however, is a problem which <br />we discovered while inspecting the fence work. Sometime since <br />this spring, a new set of wood stairs and a large wood deck <br />have been built on your lakeshore without obtaining any permits. <br />The building inspector recalls talking to you this spring. He <br />recalls stating that the stairs could be permitted but that <br />any deck within 75' of the shoreline was illeaal. The deck <br />as built actually overhangs the shoreline, <br />Mr. Kane, this deck construction is in violation of Orono Zoning <br />34.202 (enclosed) and State Building Code Section <br />301(a). Because of the zoning code violation, I must ask you <br />to have the entire deck structure removed within 30 days, not <br />later than November 6,1981. Failure to do so will result in <br />issuance of violation tags.
