Date: November 12, 2024 Item: 14 <br />Presenter: Laura Oakden, Community Development Director <br />Section: Consent Agenda <br /> <br />Title: LA24-000046, 865 Partenwood Road, Variance - Resolution 7527 <br /> <br /> <br />1.Purpose: <br />The applicant is requesting variances for 75-foot lakeshore setback and hardcover within the 75- <br />foot lakeshore setback order to construct a deck to an existing home <br />2.MN§15.99 Application Deadline: <br />An application was submitted on August 21, 2024. The application was considered complete <br />September 19, 2024. The 60-day review period expires November 18, 2024. <br />3.Background: <br />The subject property has a home that is going through a remodel project. The majority of the <br />house sits within the 75-foot lake setback as the parcel is on a peninsula with lake on three (3) <br />sides of the home. The property has an at-grade patio and landscaping areas with plastic base <br />around the north side of the home all of which is considered hardcover. The applicant is proposing <br />to remove the at grade patio and hardscape and replace it with a new 55 foot by 16-foot deck <br />structure that is roughly 14 inches above grade. This is a change in character of the hardcover from <br />a patio to a deck structure as well as being located whole within the 75-lakeyard setback. The <br />proposed deck is a similar size and location to the current improvements and will result is an <br />overall decrease in hardcover within the 75-lakeyard setback. <br /> <br />The project summary and complete variance practical difficulty analysis included in a Planning <br />Report. <br />4.Planning Commission Vote and Comment: <br />On October 21 the Planning Commission held a public hearing and discussed the requested <br />variances. No public comments were submitted Following the public hearing, the Commission <br />voted 5 - 0 to recommend approval of the variances as applied. <br />5.Public Comment: <br />The abutting neighbors submitted neighbor acknowledgement signatures for the project. <br />6.Staff Recommendation: <br />Staff recommends approval. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />Council should move to adopt Resolution 7527, approving the requested variances. <br />Exhibits <br />Ex A.
