APPENDIX <br />MAJOR LAWS <br />AFFECTING LAKE MANAGEMENT <br />The following arc brief descriptions of the major laws regarding management of lakes and other bodies <br />of water. <br />GENERAL POLICIES <br />Mi,m. Chapter 105: Division of Waters. Soils, and Minerals (first enacted 1969) <br />To conserve and use the state's water resources and to promote the public herdth, safety, and <br />welfare ~ (a) subject to existing rights, the public waters and wetlands arc subject to the control <br />of the state; (b) the state shall control the appropriation and use of surface and groundwaters: <br />and (c) the state shall control any activity that changes the course, current, or cross-section of <br />public waters or wetlands. <br />Minn. Slot.. Chapter 86: "Outdoor Recreational Act of 1975" <br />Establishes that the state should make its abundant opportunities for outdoor recreation and <br />education available to all citizens of Minnesota. Finds that the outdoor recreational needs of the <br />people of Minnesota will be best served by an outdoor recreational system that preserves <br />Minnesota's natural and historical heritage and provides an adequate supply of scenic, <br />accessible, and usable lands and waters. Includes authorization to establish several units of the <br />system, including water access sites, natural state parks, recreational state parks, wild, scenic, <br />and recreational rivers and wilderness areas. <br />Minn. Sta*. §97A. 141: Public Water Access Sites <br />Allows the commisshner to acquire access sites to public waters by gift, lease, purchase, <br />easement or conder.mation, with approval of the Executive Council. Also addresses au^uisiuon <br />of right-of-way for access roads to the access site. <br />Afr/in. Sror. §378.321: PublK Access Restrictions (enacted 1986) w n ^ <br />Provides that the same types and sizes of watercraft and horsepower of motors must be allowed <br />to access and enter water bodies as arc generally allowed to be operated on the water body. <br />Special use exceptions that are not dependent on lakeshore or property ownership may be <br />granted by permiL <br />SURFACE USE <br />M/nn.
