a. The house was placed on the property in 1968 prior to <br />the current regulations for the development of lakeshore <br />properties. <br />b. The original permit for house covered the lakeshore <br />deck. <br />c. There is no visual impact created by the screened <br />enclosure of the patio area because of the existing <br />topography and mature trees that surround residence. <br />d. Applicant is reducing hardcover within the 0-75' and <br />75-250' setback areas. <br />4. The Orono Planning Commission recommended approval of the <br />conditional use permit based on the following findings: <br />a. The installation of the loop drive will provide a safe <br />access to the County road. <br />b. Steep topographies within the street yard require land <br />alterations/modifications to existing topography in order to <br />provide safe and easy access. <br />c. Proposed filling project will have no impact on the <br />existing drainage nor on the adjacent properties. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />would not adversely affect traffic conditions# light# air nor <br />pose a fire hazard or other danger to neighboring properties; <br />would not merely serve as a convenience to the applicant# but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of rhe appli­ <br />cant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />6. The City Council finds that granting a conditional use permit <br />to allow grading and filling activities to install a loop <br />driveway on the property will not be detrimental to the health# <br />safety or general welfare of the public# would not adve*\^ely <br />affect light# air nor pose a fire hazard or other dansar to <br />neighboring properties# nor will it depreciate surrc .*n'%?.ng <br />Page 2 of 7
