A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODS <br />SECTION 10.28, SUBDIVISION 5 (B} <br />AND DENIES VARIANCES TO <br />SECTION 10.03, SUBDIVISION 15 (C) <br />AND SECTION 10.03, SUBDIVISION 18 <br />PILE #1502 <br />WHEREAS, Michael Hilbelink (hereinafter "the <br />applicant") has an interest in the property located at 2180 <br />Prospect Avenue within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />R' r e t to <br />property"); and <br />Exhibit A attached (hereinafter "the <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.28, Subdivision 5 <br />(B)to permit the construction of a single family residence on a <br />lot that consists of 22,490 square feet or .516 acres where 2 <br />acres is required and a side/strect setbacJc variance that would <br />place t.'r> structure 23.5' instead of the required 50'. The <br />applicant also seeks variances to Section 10.03, Subdivision 15 <br />(C)and Section 10.03, Subdivision 16 to allow a 5' fence in a <br />required yard area that would allow a 3' to 3-1/2' high fence. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1.This application was reviewed as Zoning File #1502. <br />2.The property is located in the RP-IB, Rural Residential <br />Zoning District requiring 2 acres of dry contiguous land. <br />The subject property consists of 22,490 square feet or .516 <br />acres. <br />3. The Orono Planning Commission reviewed this application <br />on March 19, 1990, April 16, 1990 and May 21, 1990 and <br />recomm ended approval of the proposed variance application as <br />amended based upon the following findings: <br />Page 1 of 5
