Prior to scheduling the application before the Council, <br />applicant's surveyor to provide an amended site plan of Lot <br />1 designating existing hardcover improvements to be removed <br />so that hardcover is maintained at 25% within the 75-250* <br />setback area. Hardcover to be removed prior to final plat <br />approval. <br />4. Final plat shall include the following; <br />a) designation and dedication of Casco Point Road <br />adjacent to south lot lines of property; <br />b) drainage and utility easements along perimeters of <br />property and along shared lot lines, 5* in width; <br />c) Drainage easement is to be shown 5* either side of <br />drainage ditch, plat to dedicate drainage and drainage <br />and utility easements to the City. <br />5. Name plat. <br />6. Future owner of Lot 2 is hereby advised that hardcover <br />within the 75-250* area is to be limited to 25%. <br />Additional Comnents and Planning Commission Recommendation - <br />June 6, 1990 <br />The applicant's surveyor and representative. Bob Smith, <br />confirmed that Lot 2 contained 1/2 acre of contiguous land <br />exclusive of the drainageway at the southeast corner and the <br />small portion of dry buildable divided from the buildable <br />envelope by that drainageway. In addition, the Planning <br />Commission advised applicant that there is an excessive amount of <br />hardcover within the 75-250* setback area now that the 1/2 acre <br />of dry buildable of land was to be taken from proposed Lot 1. <br />Planning Commission further added that this excessive hardcover <br />would have to be removed prior to final plat approval. Mr. <br />Smith, the applicant's surveyor, has submitted a revised plan <br />(Exhibit H), that depicts the 923 square feet of excessive hard <br />cover scheduled for removal. <br />Planning Commission also concurred that restrictive <br />covenants should be filed against both Lots 1 and 2 limiting and <br />prohibiting all use of the lake by the non-riparian lot. Lot 2. <br />The City Attorney's office has been advised of the need to <br />prepare the restrictive covenants for execution by the applicant <br />to be filed against the chain of title with the filing of the <br />final plat. <br />In regard to the realignment of the drainage ditch, it <br />should be noted that the 1/2 acre dry contiguous envelope has <br />been confirmed based on the realigned drainage ditch. It should <br />also be a condition of preliminary approval that the realigned <br />drainage ditch be completed prior to the approval of the final <br />plat. Subdivision approval shall be based on Lot 2 containing <br />the 1/2 dry contiguous lands and the existing drainage ditch <br />encroaches the 1/2 acre buildable envelope. <br />The Planning Commission recommended approval of the 2 lot <br />plat as proposed and adopted the staff recommendatic .i for <br />approval. The enclosed resolution has been drafted per the <br />approval recommendation of the Planning Commission.
