Review Exhibit C, <br />applicants' engineer, Mr. Duffy, confirms the structure is in <br />sound condition noting possible need to make remedial repairs to <br />masonry foundation at some future time. The question to be <br />answered by the Council is will the remedial repair of the <br />masonry wall be allowed? <br />The Building Inspector has confirmed that all water supplies <br />to the boathouse have been closed off. The sink has been <br />removed, the stove was stored in the exterior yard waiting to be <br />removed, the refrigerator remained in the structure. Applicants <br />have asked for special consideration to allow refrigerator to <br />remain for family and guest use of the three season porch area. <br />Primary use shall remain as an accessory use of the principal <br />residence serving as a three season porch in the upper level and <br />storage area in the lower level. <br />Please review Exhibit E, the existing boatliouse is located <br />2'4" from the west side lot line. The principal portion of the <br />structure is 9'4" from the 929.4', the deck is 4'. <br />As directed by the Council, the staff has prepared an <br />approval resolution granting the variances that would allow the <br />unapproved recent structural repairs to the structure and because <br />of the unique history of this structure, the structure shall <br />remain but no structural repairs will be allowed. The resolution <br />provides a forewarning to the applicants and future owners of the <br />limitations on the use of the structure. There may be no <br />intensification of use and that any repairs to the structure will <br />require a building permit and approval by the City. The <br />applicants have asked to be allowed to have the refrigerator <br />remain in the three season porch. Council should provide <br />direction. Please note that the new deck added to the lake side <br />of the structure requires not only a lakeshore setback variance, <br />but a side setback variance (10' side setback required from side <br />lot line).
