ORDINANCE NO.SECOND SERIES <br />AN ORDINANCE ESTABLISHING A MORATORIUM ON THE GRANTING OP <br />BUILDING PERMITS, LAND SUBDIVISlOH/ZOHING APPLICATIONS, <br />CONDITIONAL OR SPECIAL USE PERMITS, VARIANCES OR EVERY OTHER <br />AUTHORITY FOR THE DEVELOPMENT OF ANY FACILITIES OF A LOCAL <br />GOVERNMENT APART FROM THE CITY OP ORONO’S FACILITIES OR THE <br />SCHOOL DISTRICT WITHIN THEIR OWN BOUNDRIES. <br />The City of Orono ordains: <br />The municipal Code of the City of Orono is amened by <br />adding Ordinance No. _ _, Second Series. <br />Section 1. Statement of Policy. - The City Council finds <br />the City is faced with potential for applications for development <br />of local government facilities which raise the potential issue as <br />to the most appropriate land use, compatibility with residential <br />development together with the potential threat for annexation of <br />property so developed into that of another jurisdiction. The <br />City is in the process of re-evaluating its official controls in <br />order to determine what appropriate place, if any, there is to <br />permit such facilities within its jurisdictional boundries. The <br />Council finds that amending any other official controls can not <br />be done until a study is completed and a hearing held. During <br />this interim period it is desirable that Council establish <br />criteria for those who wish to develop property in order to bring <br />about savings in public and private expenditures and provide <br />public guides to the future City action. <br />The City determines there is an urgency involved because <br />of the need to control development during the interim period so <br />that the benefits of proper planning will not be lost, to <br />preserve the status quo pending adoption of these measures so the <br />City will not be impared in its ability to effectuate the <br />purposes :*nd goals of these planning efforts. <br />Since enactment of an ordinance will undoubtedly modify <br />existing regulation concerning permitted land use and zoning <br />performance standards, the granting of various zoning and permit <br />applications during this interim period would be detrimental to <br />the effectuation and contrary to the purpose of the zoning <br />enabling act. <br />The Council further finds that it would be unwise, <br />improper and unjust to allow individual development to occur <br />during this study period to avoid discrimination and unfair <br />advantage to a few to the detriment of the entire City. <br />Therefore, the Council and staff's authority to grant permits <br />described herein shall not be exercised during the limited term <br />of this ordinance, except as provided in Section 6. <br />Section 2.
