Zoning File #1502 <br />April 11, 1990 <br />Page 3 of 3 <br />Partial approval. Recommendation to approve the lot area <br />and setback variance for the preposed structure but denying the <br />height and setback variance for the proposed fencing along the <br />south property line. Approval may be based on one or more of the <br />following findings; <br />1. The property consists of .62 acres and is subject to 2.0 <br />acre zoning standards. <br />2. The property is corsistent with the surrounding 1/2 - <br />3/4 acre pattern of development within the Crystal Bay <br />neighborhood. <br />3. The property is served with sewer. <br />4. A residence had existed on the property for over 40 <br />years. The structure was located closer to the southern <br />property line/Prospect Avenue than the proposed structure at <br />22*. <br />5. There is no additional area available for the <br />acquisition to increase the buildinv envelope. <br />Approval must include the following conditions; <br />1. Prior to issuance of a building permit by the City for <br />the new construction, applicant must provide proof from the <br />County that delinquent real estate taxes and special <br />assessments have been paid. Applicant is once again advised <br />that there is approximately $6,825.84 incurred by the City <br />as a result of the hazardous building action. This fee is <br />in the process of being assessed against the property. <br />Applicant will have opportunity to pay this off prior to the <br />formal assessment ordered by the courts. <br />2. New driveway access off Briar Street must be reviewed by <br />Public Works Director prior to the issLance of a building <br />permit. <br />3. Connection to municipal sewer prior t»-» the issuance of a <br />Certificate of Occupancy. <br />4. City Engineer to review final drainage/grading plans for <br />new construction prior to issuance of a building permit. <br />5. Granting of a 1?’ wide drainage easement along the north <br />boundary line and the granting of drainage and utility <br />easements (10' along southern property line and 5' along <br />west property line).
