1. Prior to the issuance of a building permit by the City <br />for the new construction, applicant must provide proof from <br />the County that delinquent real estate taxes and special <br />assessments have been paid. Appl cant is further advised <br />that there is approximately $6,825.b4 incurred by the City <br />as a result of a previous Hazardous Building Action against <br />this property. This fee is in the process of being assessed <br />against the property. Applicant wilI have an opportunity to <br />pay this off prior to the formal assessment to be ordered by <br />the Courts. <br />2. All new construction must satisfy required setbacks of <br />the RR-IB Zoning Jistrlctd which are as follows; <br />Front/-^de street = 50' <br />Side » 30' <br />3. New driveway access at Briar Street must be reviewed by <br />Public Works Director prior to the issuance of a building <br />permit. <br />4. Connection to municpal sewer prior to the issuance of a <br />Certifies . of Occupancy for new residence. <br />5. City Engineer to review final drainage/grading plans <br />for new construction prior to issuance of a building permit. <br />6. Granting of a 10' wide drainage easement along the <br />north boundary line and the granting of drainage and utility <br />easements 10' along southern property line and 5' along west <br />property line. <br />7. Authorities granted by this variance run with the <br />property not with the applic . but are permissive only and <br />iiust be exercised appl cion for a building permit <br />within one year o late £ Council approval, or this <br />variance will expi chat date (May 14, 1'<91). <br />8. Violation of o .i jn-compliance with any of the terms <br />and conditions of this variance shall constitute a violation <br />of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />9. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of <br />the property. <br />Page 3 of 5
