Mabusth, Building & Zoning Administrator <br />Datet Jainuary 11, 1990 <br />Subject: #1467 Charles & Ann Hommeyer, 4125 Oak Street - <br />Variances - Public Hearing <br />Pertinent Ordinance - <br />Section 10.22, Subdivision 1 - <br />After-the-Fact Portion: <br />A) The retaining walls and deck area located within 75' of <br />the lake. <br />1. The retaining walls are located adjacent to a sand <br />blanket at the shoreline. <br />2. The deck is approximately 45' from the shoreline. <br />Note the survey submitted with application does not <br />designate the 929.4 elevation. <br />3. 13.5*x5.42' deck within lakeshore yard requires an <br />average lakeshore setback approval. <br />Current Request: <br />B) The applicants seek a setback variance to the average <br />lakeshore setback for a fence 6 in height that will extend <br />approximately 30' in front of the average lakeshore setback <br />line. Please review Exhibit B. The fence is located along <br />the north side lot line adjacent to the newly constructed <br />home. <br />Section 10.22, Subdivision 2 - <br />A) Hardcover variance required within 0-75' setback area <br />(review Exhibits G & N). <br />Allowed * 0% <br />Proposed * 287.37 s.f. or 3.68% <br />B) 75-250' setback area. Applicant notes 27.1%, review <br />Exhibit O. Note, staff cannot confirm accuracy of 75-250* <br />hardcover inventory as survey has not been submitted showing <br />updated improvements. At 27.1%, the 75-230' setback area <br />already has excessive hardcover.
