2 <br />211089v6 <br />(35) days of the receiptof the invoice. If the dispute has not resolved by the end of the payment period, <br />the School District will pay the full undisputed amount within thirty-five (35) calendar days. <br />The cost of this Agreement shall not exceed 50% of the School District’s proportionate amount <br />collected through the Safe Schools Levy. The School District shall notify the City of the total amount <br />actually levied through a Safe Schools Levy, and the parties maymutually determine invoice amounts if <br />the total payments outlined above are nearing or have exceeded this cap. <br />4. ADDITIONAL SERVICES. School District administrators may request that the City assign one or <br />more peace officers to provide “additional services” outside the hours of a school day. The City is not <br />obligated to provide additional services, and shall provide additional services when requested by the <br />District at the City’s sole discretion. <br />5. SCHOOLS TO RECEIVE SERVICES. The City will provide SRO services under this Agreement to the <br />following schools in Independent School District 278 (collectively, “School”): <br />a. Orono High School, 795 Old Crystal Bay Road North, Long Lake, MN 55356; <br />b. Orono Middle School, 800 Old Crystal Bay Road North, Long Lake, MN 55356; <br />c. Orono Intermediate School, 685 Old Crystal Bay Road North, Long Lake, MN 55356; and <br />d. Orono Schumann Elementary School, 765 Old Crystal Bay Road North, Long Lake, MN 55356 <br />6. ASSIGNMENT OF SCHOOL RESOURCE OFFICERS. The City will employ or assign 1 full-time (1.0 <br />FTE) licensed peace officer to perform SRO duties on a full-time basis during each school day, during the <br />regular school year(up to170-180schooldays) covered by the term ofthis Agreement. The City will work <br />collaboratively with the school district to determine which of its police officers to assign to serve as the <br />SRO(s) under this Agreement. The number of police officers serving in the SRO(s) position at the School <br />may be modified at any time upon the written agreement of the City and the School District.The provision <br />of all such SRO(s) shall be subject to the terms and conditions of this Agreement. There will be no SRO(s) <br />when the school district is in distance learning at any of the schools. No payments will be made to the <br />cities when SRO(s) are not on site. <br />7. SUPPLIES AND EQUIPMENT. The School District may provide office space for the SRO at the <br />assigned school. Any office spaces and supplies shall be at the School District’s expense. The District shall <br />not be required to provide any additional supplies or equipment. <br />8. COMPENSATION TO SRO(s). The City will be responsible for all payments regarding <br />compensation, benefits, pension plans and withholdings for its officer(s) serving as the SRO(s) at the <br />School(s). The Parties will, except as provided herein, act in their individual capacities and not as agents, <br />employees, partners, joint ventures or associates of the other. Neither of the Parties, nor its personnel, <br />employees, agents, contractors, or servants, shall be entitled to any benefits of the other. The Parties will <br />not provide any insurance coverage to the other or their employees including, but not limited to, workers’ <br />compensation insurance. Each Party will pay all wages, salaries and other amounts due its employees and <br />will be responsible for all reports, obligations, and payments pertaining to social security taxation, income <br />tax withholding, workers compensation, unemployment compensation, group insurance coverage, <br />collective bargaining agreements or any other such similar matters. <br />9. DUTIES AND WORK SCHEDULE OF THE OFFICER. The law enforcement services provided to the <br />School District by the SRO(s) will be at the sole discretion of the City. Officer standards of performance, <br />conduct and discipline of the officer, performance reviews and other internal matters related to the <br />41
