AFMN Community Grant Application with Assurances (GK203)23 <br />13.Affirmative Action and Nondiscrimination <br />a.The Grantee agrees not to discriminate against any employee or applicant for employment <br />because of race, color, creed, religion, national origin, sex, marital status, status in regard to <br />public assistance, membership or activity in a local commission, disability, sexual orientation, or <br />age in regard to any position for which the employee or applicant for employment is qualified per <br />Minnesota Statutes, section 363A.02 (https://www.revisor.mn.gov/statutes/?id=363A.02). The <br />Grantee agrees to take affirmative steps to employ, advance in employment, upgrade, train, and <br />recruit minority persons, women, and persons with disabilities. <br />b.The Grantee must not discriminate against any employee or applicant for employment because of <br />physical or mental disability in regard to any position for which the employee or applicant for <br />employment is qualified. The Grantee agrees to take affirmative action to employ, advance in <br />employment, and otherwise treat qualified disabled persons without discrimination based upon <br />their physical or mental disability in all employment practices such as the following: employment, <br />upgrading, demotion or transfer, recruitment, advertising, layoff or termination, rates of pay or <br />other forms of compensation, and selection for training, including apprenticeship. Minnesota Rules, <br />Part 5000.3500 (https://www.revisor.mn.gov/rules/?id=5000.3500). <br />c.The Grantee agrees to comply with the rules and relevant orders of the Minnesota Department of <br />Human Rights (MDHR) issued pursuant to the Minnesota Human Rights Act. It is the Grantee’s <br />sole responsibility to apply for a workforce certificate and/or equal pay certification if required by <br />MDHR prior to the execution of a grant award. <br />14.Pre-Award Work and Pre-Award Costs <br />The Grantee understands that no work should begin, and no pre-award costs would be covered under <br />this award until all required signatures have been obtained; an Official Grant Award Notification <br />(OGAN) has been issued and the Grantee is notified to begin work by the state’s program authorized <br />representative or their designee. If an exception to this is determined necessary by State, the Grantee <br />would be informed in writing or email by the state’s program authorized representative or designee. <br />15.Grantee’s Grant Program Representative <br />The Grant Applicant’s Program Contact Representative will be named on the Official Grant Award <br />Notification (OGAN) or other award information. If the Program Contact Representative or official with <br />authority to sign changes at any time during the grant award period, the Grant Applicant/Grantee must <br />immediately notify the State. <br />16.Termination <br />A.With or Without Cause: <br />1.Without cause:An award contract may be cancelled by the State at any time, without cause, <br />upon thirty (30) days’ written notice to the Grantee. Upon termination, the Grantee will be <br />entitled to payment, determined on a pro rata basis, for services satisfactorily performed and <br />for approvable expenditures. <br />116
