CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />SENER AND HATER AGREEMENT <br />Easfc Willow Woods <br />(Name of Development) <br />Clifford L. Otten <br />(Name of Developer) <br />THIS AGREEMENT, Made and entered into this day of <br />April, 1990, by and between the City of Orono, a municipal <br />corporation organized under the laws of the State of Minnesota <br />(hereinafter called "City"), and Clifford L. Otten, his heirs, <br />successors and assigns (hereinafter called 'Developer'). <br />WITNESSETH: <br />WHEREAS, the City wishes to install certain sewer and <br />water improvements and needs land and easements for the purposes <br />thereof; emd <br />WHEREAS, the Developer has need of certain utility <br />services and owns pertinent land. <br />HOW, THEREFORE, in consideration of the premises and the <br />mutual promises and conditions hereinafter contained, it is <br />hereby agreed as follows; <br />1. Interim Production Well: The City has constructed a <br />certain 6' water well (an interim production well) on the <br />Developer's land being Lot 1, Block 1, East Willow Woods, <br />all as set forth on the Agreement attached hereto as <br />Exhibit A. The City will be constructing a permanent <br />municipal well in the future as set forth below. At the <br />time the permanent municipal well is completed the City <br />will convey its rights in the 6' interim production well <br />on said Lot 1 to the Developer for the sum of $5,000, or <br />the City will abandon the well and properly close the well <br />as provided by law at the City's expense, at the <br />Developer's election. <br />2. Sewer and Water Assessments: The Developer has already <br />signed and delivered to the City an easement for sewer and <br />water purposes over the Property (see Exhibit B). The <br />Developer has also signed and delivered to the City his <br />petition for the installation of such sewer and water <br />utilities (see Exhibit C).
