The property owner proposes to use the property in a reasonable manner not permitted <br />by the Zoning Chapter. <br />Response: The request to permit residential improvements on this lot within the lake setback <br />appears to be reasonable considering the property’s size and the neighboring support. The <br />neighboring property owners have indicated they are in support and will not be adversely affected. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />Response: The position of the residence on this property was not directed by the owner. The 1-1/2 <br />and 2nd story walk-outs are part of the existing architecture and require a deck for egress to the <br />backyard, both of which fall outside of the setback. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />Response: The variance is requested to permit modifications to the improvements being made on <br />the property which are designed to fit the character of the neighborhood and improve the neighbor’s <br />views. <br />4. Economic considerations alone do not constitute practical difficulties if reasonable use <br />for the property exists under the terms of the Zoning Chapter. <br />Response: Economic considerations have not been a factor in the variance approval determination. <br />5. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br />for solar energy systems. Variances shall be granted for earth-sheltered construction as <br />defined in Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this <br />Chapter. <br />Response: This condition is not applicable. <br />6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br />use that is not allowed under this Chapter for property in the zone where the affected <br />person's land is located. <br />Response: This condition is not applicable, as residential improvements are allowed in the LR-1B <br />District. <br />7. The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />Response: This condition is not applicable. <br />8. The special conditions applying to the structure or land in question are peculiar to such <br />property or immediately adjoining property. <br />Response: The home and the neighboring homes are built closest to the street side of the properties <br />33
