4. Concurrent with this private road, the subdivider has <br />dedicated to the City a road and utilities easement granting <br />.5 the City permanent access, improvement and utility <br />easement over said Outlot? the subdivider has created non ­ <br />exclusive ingress, egress, drainage and utility easements <br />over said Outlot in favor of all abutting and/or benefitting <br />lots including a declaration of certain maintenance <br />covenants wherein each of the abutting and/or benefitting <br />lot owners co'* "it-.s and agrees to permanently maintain and <br />pay the cost c intenance for said private road. <br />5. Dedication to the City of a Flowage & Conservation <br />Easement providing for limitations on the use of wetlands <br />shown on the plat as drainage easements. In addition <br />applicant has granted drainage easements over all <br />drainageways and storm sewer lines not already included <br />within road easements and drainage and utility easements <br />surrounding each lot. <br />6. Execution of a subdivider's agreement providing for <br />installation of certain improvements as a condition of <br />subdivision approval. <br />7. Payment to the City cf a Park Dedication Fee in the <br />amount of $3,400.00. <br />8. Payment to the City for the legal review and f iing of <br />the plat, easements and covenants in the amount of 50.00. <br />NOW, TBKRBPORB, BB IT RBSOLVBD that the City Council of <br />the City of Orono hereby approves the plat of Fox Bend, Hennepin <br />County, Minnesota; subject to the following conditions: <br />1. All 17 lots shall achieve access from the newly <br />constructed private road. <br />2. The aforesaid plat shall be filed by the City '^f Orono <br />with either the Hennepin County Recorder's Office or the <br />Registrar of Titles on or before October 9, 19*^0 together <br />with a certified original copy of this Rescjution and <br />executed copies of covenants and easements noted above. <br />The approval granted by this Resolution shall expire^ <br />the plat has not been filed by the date specified above.
