Zoning File #1504 <br />March 15, 1990 <br />Page 3 of 3 <br />Options of Action - <br />Denial. If denied, please refer to the pertinent sections <br />of the code for the necessary findings. <br />Approval as submitted. Such approval must be conditioned <br />upon the following: <br />1. The City will approve of no additional improvements on <br />this property that would be considered hardcover because of <br />excessive hardcover within the 75-250' setback area. <br />2. A building permit must be obtained for access stairs to <br />lake. Applicant's builder must submit a design of che <br />stairs for review by the Building & Zoning Department, <br />noting the standards set forth above. <br />3. Payment of a SAC fee of $600.00 with the building <br />permit. <br />4. Access to the site must be via easement from property to <br />the west. <br />5. Owner is encouraged to work with neighbor to the west to <br />minimize impact on existing improvements. During the <br />process of construction, applicant's builder must note 75' <br />setback line. All construction must remain behind the 75' <br />setback line. No storage of fill is allowed within the <br />lakeshore protected area. <br />6. The major iblem for the <br />Planning Commission was that the application involved new <br />construction on an undeveloped piece of property and found it <br />difficult to accept any hardships that would require variances <br />being granted for new construction. The applicant was encouraged <br />by staff to prepare an amended proposal for Council's review or <br />provide additional information that may persuade Council to <br />reconsider the Planning Commission's recommendation. <br />The options of action presented in the earlier part of this <br />memo for Planning Commission's consideration are still applicable <br />for the current Council review. As of this writing, staff has <br />heard nothing from the applicant, nor has staff received any <br />additional information or amended plans.
