RESOLUTION NO. l/o! <br />:■••r"r VU/'» <br />A RESOLUTION ESTABLISHING A CONDITIONAL USE PERMIT <br />FOR OPERATION OF A LAWFUL-NONCONFORMING USE OF LAND <br />1’ <br />‘ ^ <br />I <br />WHEREAS, Che Cicy of Orono, hereinafter City, is a <br />municipal corporation organized and existing under Che laws of <br />the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono, hereinafter <br />Council, has adopted a Comprehensive Guide Plan which sets forth the <br />unique characteristics and constraints affecting development within <br />the Cicy and which Flan establishes goals and guiding principles for <br />planning and reviewing oevelopmcnt within the City; and <br />WHEREAS, Che Council has adopted a Zoning Coda which <br />establishing performance standards and criteria for implementacion <br />of the guiding principles of the Comprehensive Guide Plan; and <br />WHEREAS, the Zoning Code of the City provides for the <br />continuing use of land or buildings as lawful non-confocmixig uses <br />whenever such uses were lawful uses under prior zoning regulations <br />but have since become non-conforming uses because of a lawful change <br />in the zoning code; and <br />WHEREAS, the property described below has become a ..awful <br />non-conforming use of land and buildings in the manner described above; <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the <br />Cicy of Orono hereby establishes a Conditional Use Permit for continued <br />lawful use of the following described property according to the follow!^ <br />conditions: <br />I. Property Description <br />1. Legal Description - "part oi I-ots 24, 25 and 26, "Ore <br />Park" on Lake Minnetonka and that part of Lake Street lying <br />between the extencions of side lines of said Lots 24, 25, <br />and 26, and between front lines of said Lots and Northwesterly <br />line of the Ri^^ht of Way of County Highway No. 15 (lormerly <br />No. 7) being a line parallel to and 33 feet northwesterly <br />from the center line of existing pavement of seid UigbMey"* <br />all of which is intended to be replatted es Lot 2, Tourengeeu <br />Addition. <br />2. Lot size:(ave.) 145.58 ft. wide by (eve.) 7^.55 ft. <br />deep - 11,435 sq. ft. (.26 acre). <br />I <br />i'
