ORDINANCE f SECOND SERIES <br />AN ORDINANCE AMENDING SECTION 5.24 ADOPTED APRIL 1, 1984 AND <br />ENTITLED "TOBACCO." <br />The City Council of Ocono ordains: <br />Section 5.24, Tobacco is hereby amended by adding the <br />following language: <br />Subdivision 4. <br />vending machines. <br />Tobacco Products: Prohibited Sales from <br />A. Tobacco products may be offered for sale in vending <br />machines licensed under this chaper only on premises which <br />possesses a current On-Sale Intoxicating liquor license. In <br />addition to any other requirements imposed by law, there shall be <br />placed on each tobacco product vending machine a notice as <br />follows: "If you are under age 13 and purchase or attempt to <br />purchase any tobacco product from this machine, you will be <br />subject to a mandatory fine of $100." <br />Subdivision 5. Purchase or <br />tobacco products by minors prohibited. <br />attempted purchase of <br />A. It shall be unlawful for any person who has not attained <br />the age of 18 years of age to purchase or attempt to purchase any <br />tobacco product. A person under the age of 18 years of age who <br />is alleged to have violated this section shall be subject to the <br />jurisdiction of the Juvenile Court under Minn. Stat. Section <br />260.111. In adcition ^ ) che dispositions otherwise provided by <br />law, a violation of this section shall subject the minor to a <br />fine of $100 for a first violation or $200 for any subsequent <br />violation. <br />This ordinance shall become effective the first day of <br />May, 1990. <br />Adopted by the Council at a regular meeting held <br />March 12, 1990, by a vote of ____ ayes, ____ nays. <br />ATTEST: <br />James R.
