<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7516 <br /> <br /> <br />1 <br /> <br />A RESOLUTION APPROVING <br />AN INTERIM USE PERMIT PURSUANT WITH <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-916 & 78-1726 <br /> <br />FILE NO. LA24-000045 <br /> <br /> WHEREAS, on August 21, 2024, on behalf of the Park Gun Club, Larry Compton, <br />President, (hereinafter “the Applicant”), applied for an interim use permit for soil processing and <br />mining activities associated with a lead reclamation project conducted within the property <br />addressed 3660 Sixth Avenue North and legally described as: <br /> <br />Attached as Exhibit A (hereinafter the “Property”); <br /> <br /> WHEREAS, the Applicant made an application to the City of Orono for an interim use <br />permit (hereinafter the “IUP” pursuant to Orono Municipal Zoning Code Sections 78-916 and 78- <br />1726 to conduct a lead reclamation project involving soil processing and mining within the <br />Property; and <br /> <br /> WHEREAS, on September 16, 2024, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were allowed to speak thereon; <br />and <br /> <br /> WHEREAS, on September 16, 2024, the Planning Commission recommended approval <br />of the IUP as described; and <br /> <br /> WHEREAS, on October 14, 2024, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested IUP as described above based on one or more of the following <br />findings of fact concerning the Property: <br /> <br />FINDINGS OF FACT: <br /> <br />A1. The analysis contained within staff memos and the exhibits attached to the aforesaid <br />memos, all minutes from the above-mentioned meetings, and all other materials <br />distributed at these meetings are hereby incorporated by reference. <br /> <br />A2. The Property is located in the RR-1B, One Family Rural Residential Zoning District. <br />134
