<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7515 <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-420, 78-1438 & 78-1700 <br /> <br />FILE NO.LA24-000044 <br /> <br /> WHEREAS, on August 20, 2024, the owner, William Anderson (hereinafter the “Applicant”), <br />applied for variances from the City Code for the property addressed 1335 Briar Street and legally <br />described as: <br /> <br />East 100 feet of Lot 1, Block 3, Markville, Hennepin County (hereinafter the <br />“Property”); <br /> <br /> WHEREAS, the Applicant has made an application to the City of Orono for variances to <br />Orono Municipal Zoning Code Section 78-420 to allow the following in conjunction with <br />the construction of a new 21’ x 23’ detached garage and a new 5’ x 10’ front stoop: <br />• A front yard setback variance to permit a new, expanded stoop 22 feet from the front <br />where 50 feet is required; <br />• Rear yard setback variance to allow a 5-foot setback for the garage where a 15-foot <br />setback is required; <br />• Side street setback variance to the garage to be set 23.8 feet where a 50-foot setback is <br />required; <br />• A side yard setback variance for the garage to be 5 feet from the lot line where a 10-foot <br />setback is permitted; and <br /> <br /> WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br />Orono Municipal Zoning Code Section 78-1438 to allow a 6.5-foot separation between the home <br />and the new garage; and <br /> <br /> WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br />Orono Municipal Zoning Code Section 78-1700 to allow 39.3% hardcover where 42.5% exists <br />and 35% is permitted; and <br /> <br /> WHEREAS, on September 16, 2024, after published and mailed notice following <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were allowed to speak thereon; <br />and <br /> <br /> WHEREAS, on September 16, 2024, the Planning Commission recommended approval <br />of the variances as applied; and <br />106
