Date: October 14, 2024 Item: 18 <br />Presenter: Melanie Curtis, Planner <br />Section: Consent Agenda <br /> <br />Title: LA24-000044, 1335 Briar St, Variances, Resolution No. 7515 <br /> <br /> <br />1.Purpose: <br />The purpose of this action item is to consider variances to construct a new front stoop and a <br />detached garage on the property. <br />2.MN§15.99 Application Deadline: <br />This application was submitted and considered to be complete on August 20, 2024. The 60-day <br />review timeline will expire on October 19, 2024. <br />3.Background: <br />There is no garage on the subject property; the owner proposes to remove the existing shed to <br />construct a new, detached garage. The applicant also proposes a larger more functional 5’x10’ <br />front stoop to replace an existing 4.5' x 4.5' stoop. <br /> <br />The proposal requires the following variances: <br />Front yard setback variance to permit the stoop to be expanded 22 feet from the front where <br />50 feet is required; <br />Rear yard setback variance to allow a 5 foot setback for the garage where a 15 foot setback <br />is required; <br />Side street setback variance to the garage to be set 23.8 feet where a 50 foot setback is <br />required; <br />A side yard setback variance for the garage to be 5 feet from the lot line where a 10 foot <br />setback is permitted; <br />A variance from the 10-foot building-to-building setback to allow a 6.5 foot separation <br />between the home and the new garage; and <br />A hardcover variance to permit the changes to site resulting in a reduction from 42.5% to <br />39.3% where 35% is permitted. <br /> <br />The project summary and complete variance practical difficulty analysis is included in the <br />Planning Report. <br />4.Planning Commission Vote and Comment: <br />On September 16, the Planning Commission held a public hearing and discussed the requested <br />variances. Following the public hearing, the Commission voted 5 - 0 to recommend approval of the <br />variances as applied.
