'ri--r��c� ,f—r..—ll—y <br />11 <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 655,, <br />A RESOLUTION <br />ACCEPTING GLENDALE COVE LANE AS A PUBLIC ROAD <br />AND ACCEPTING SPECIFIED IMPROVEMENTS IN GLENDALE COVE <br />AS PUBLIC FACILITIES - ZONING FILE #05-3131 <br />WHEREAS, on July 20, 2006 the City of Orono (the "City") and Bohland <br />Glendale Cove, LLC (the "Developer") entered into Planned Unit Development Agreement No. <br />5 (the "Agreement") which in conjunction with City Council Resolution No. 5480 documented <br />the terms and conditions under which the development known as "Glendale Cove" was <br />approved; and <br />WHEREAS, the terms of the Agreement and Resolution specify that Glendale <br />Cove Lane shall be a public road, and the sewer, water and storm sewer lines serving the <br />development will be owned and maintained by the City; and <br />WHEREAS, the terms of the Agreement and Resolution further specify that the <br />Developer shall construct a public trail within an easement in Lots 2 and 3, Block 1, Glendale <br />Cove; and <br />WHEREAS, the City Engineer has recommended that the City formally accept <br />the Improvements; and <br />WHEREAS, in addition to the public road, sewer, water and storm sewer <br />improvements, the public trail constructed by the Developer in Lots 2 and 3, Block 1, Glendale <br />Cove is recommended for acceptance; and <br />WHEREAS, it is now appropriate that the City of Orono formally accept these <br />Developer -installed facilities as public; and <br />WHEREAS, this acceptance specifically does not include the wetland buffer and <br />stormwater management facilities for which maintenance responsibilities are established with the <br />Glendale Cove property owners per Document No. 8940428 dated 212112007. <br />NOW, THEREFORE BE IT RESOLVED that the City Council of Orono <br />Minnesota does hereby formally accept the Public improvements associated with Glendale Cove <br />including the public road, the municipal water, sewer, and storm sewer lines, and the trail <br />Page 1 of 2 <br />
