<br /> <br /> <br />26 _________ <br /> Initial <br /> <br />EXCLUSION OF CONSEQUENTIAL AND INCIDENTAL DAMAGES Warranty Exclusions: <br /> <br />• Hazing, chalking or loss of gloss caused by improper care, abrasive polishes, cleaning agents, heavy-duty <br />pressure washing or aggressive mechanical wash systems. <br />• Paint deterioration caused by abuse, accidents, acid rain, chemical fallout or acts of nature. <br />• Exception is made for Axalta supplied anti-graffiti coatings systems cleaned with Axalta approved cleaning <br />products. <br />• Accidents, scratches, chips, bruises and gloss reduction due to normal vehicle use and maintenance. <br />• Custom finishes; exotic finishes or any finish not conforming to standard refinish procedures. <br />• Finishes on vehicles used for competitive purposes <br />• Failures resulting from product misuse or abuse. <br />• Repairs done over previously refinished areas or appropriate substrate. <br />• Claims presented without proper Warranty documentation <br />• Failure on finished utilizing products not approved by Axalta for use in systems applied on vehicles covered <br />under the warranty. <br />• Failure on finishes performed by Non- Axalta Certified Refinish Technicians <br />• Failure on finishes performed by Non- Axalta Certified Repair Centers <br />• Failure on finishes performed by Axalta Certified Refinisher that has let their certification expire. <br /> <br />IN NO EVENT SHALL CET FIRE PUMPS MFG INC BE LIABLE FOR AN INCIDENTAL, SPECIAL, INDIRECT OR <br />CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM NONDELIVERY OR FROM THE USE, MISUSE <br />OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT OR FROM THE NEGLIGENCE <br />OF CET FIRE PUMPS MFG INC OR FROM TORT. This exclusion applies regardless of whether such damages <br />are sought for breach of warranty, breach of contract, negligence or strict liability or tort or under any other legal <br />theory. <br /> <br />WARRANTY WORK EXECUTED BY ANY ONE OTHER THEN CET FIRE PUMPS MFG INC WILL NOT BE <br />COVERED, UNLESS APPROVED PRIOR TO ANY WARRANTY WORK BEING DONE BY AN AUTHORIZED CET <br />FIRE PUMPS MFG INC REPRESENTATIVE. <br /> <br />NOTE: Surety Bond, if a part of the sale of the vehicle, to which this limited warranty is provided, applies only to the <br />General One-Year Warranty for such vehicle, and not to any other warranty made by CET Fire Pumps MFG Inc. or <br />any CET Fire Pumps MFG Inc.
