Date: September 9, 2024 Item: 11 <br />Presenter: Melanie Curtis, Planner <br />Section: Public Hearings <br /> <br />Title: Public Hearing - Vacate Easements - Honey Hill #LA24-000030, 3465 6th <br />Ave N & 3515 6th Ave N, including PIDs 29-118-23-43-0013, 29-118-23-44-0004 <br />& 29-118-23-44-0006 <br /> <br /> <br />1.Purpose: <br />The purpose of this request is for Council to hold a Public Hearing and review the proposed <br />vacation of redundant and/or conflicting drainage and utility easements supporting the plat of <br />Honey Hill on Lake Classen. Replacement easements will be dedicated as part of the forthcoming <br />final plat approval. <br />2.MN§15.99 Application Deadline: <br />The vacation request is part of the final plat application that was submitted on July 29, 2024 and <br />considered to be substantially complete on August 15, 2024. The 60-day final plat application <br />review period will end on October 14, 2024. <br />3.Background: <br />On July 8, 2024, Council adopted Resolution No. 7490 granting preliminary plat approval for the <br />plat of Honey Hill on Lake Classen, a 6-lot subdivision. Because the existing perimeter drainage <br />and utility easements will become obsolete or interfere with the newly platted lots, the applicant is <br />requesting approval to vacate the unnecessary easements. As part of the final plat approval, new <br />perimeter drainage and utility easements will be dedicated around each of the individual lots; <br />additional drainage easements will also be dedicated over wetlands, wetland buffers, and <br />stormwater drainage swales. <br /> <br />The existing overhead power line situated along the eastern property line will be encompassed into <br />the drainage and utility easements to be dedicated over the eastern lot line of proposed Lots 5 and <br />6 (see Exhibit A). The Notice for the public hearing was published in the August 24, 2024 edition <br />of the Laker Pioneer newspaper. <br /> <br />The final plat approval is scheduled for the September 23rd City Council agenda. The public <br />hearing for easement vacation was not held by the Planning Commission at the time of preliminary <br />plat review. Therefore the Council is asked to hold the public hearing and make a motion <br />regarding the vacation request at this time. <br />4.Staff Recommendation: <br />Staff recommends the city council hold a public hearing and for the council to recommend <br />approval. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />The Council is requested to do the following regarding the vacation request: <br /> <br />1.
