Upon approval of this Resolution the City Council shall direct the Mayor and <br /> Clerk to execute other documents required by this PUD rezoning, including but <br /> not limited to the Agreement for PUD No. 7. <br /> 4. The Developer shall execute the Stormwater Maintenance Agreement as noted <br /> within the Agreement for PUD No. 7. <br /> 5. The Developer shall establish an escrow account and executing an Escrow <br /> Agreement as established within the Agreement for PUD No. 7. <br /> 6. The Developer shall provide a Letter of Credit for the amount noted in the City <br /> Engineer's Estimate and established within the Agreement for PUD No. 7. <br /> 7. The Developer shall prepare, execute and provide an acknowledgment of risk for <br /> parking lot, road and underground utilities as set forth within the City Engineer's <br /> memo dated March 23, 2011. <br /> 8. The residence structure developed on the property shall be in conformity with the <br /> location, design and size requirements established in Resolution 5948 and in <br /> conformity with the Agreement for PUD No. 7. Any proposed development <br /> determined by the City to not be in conformity with said Agreement may be made <br /> only after a public hearing conducted by the Council. Any changes shall be <br /> recorded as amendments to the recorded copy of the final development plan. <br /> 9. If substantial development has not occurred within one year after approval of <br /> PUD No. 7 as set forth in the Agreement for PUD No. 7, the City Council may <br /> declare the approvals granted within this resolution and within said Agreement as <br /> null and void. <br /> 10.The Agreement for PUD No. 7 shall be filed with Hennepin County on or before <br /> March 28, 2012 together with a certified original copy of this resolution and <br /> executed copies of the Agreements, easements, and covenants pertinent <br /> thereto. The approval granted by this Resolution shall expire if the Agreement <br /> for PUD No. 7 has not been filed by the date specified above. In that event, it will <br /> be necessary to file a new application with the City of Orono for subdivision <br /> review. <br /> Page 4 <br />
