.� o,� <br /> � O , O CITY of ORONO <br /> �'a <br /> � ' ' �+ RESOLUTION OF THE CITY COUNCIL <br /> �� ��y G�� No. 6 0 9 2 <br /> �9kESH�g'� <br /> WHEREAS, within the 0 to 75' foot zone 167 square feet of hardcover (the <br /> existing shed and stairs) was previously approved by the O1/13/09 Agreement filed as Hennepin <br /> County Document No. T4688800; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held <br /> a public hearing on October 17, 2011 at which times all persons desiring to be heard concerning <br /> this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> ( l. This application was reviewed as Zoning File 11-3528. <br /> 2. The Property is located in the LR-1B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acres and a minimum lot width <br /> of 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> October 17, 2011 and recommended approval of a setback variance for the <br /> retaining wall; as well as 75' to 250' zone and 250' to 500' zone hardcover <br /> variances,based on the following findings: <br /> a. The Property contains 27,111 square feet (0.62 acre) in area and has 54 feet in <br /> width. <br /> b. Sanitary sewer is available. <br /> c. There is no additional land available to bring the lot area into conformity. <br /> d. The location of the home, the topography of the lot combined with the <br /> location of the Property along CSAH 19 requires a driveway turnaround be <br /> provided on site. <br /> � e. The topography of the Property creates a practical difficulty for safely backing <br /> � out of the current driveway configuration, particularly in winter months. <br /> � Page 2 of 5 <br />
