Date: September 16, 2024 Item: 5.1 <br />Presenter: Melanie Curtis, Planner <br />Section: Public Hearings <br /> <br />Title: #LA24-000044, William Anderson, 1335 Briar Street, Variances, Public <br />Hearing <br /> <br /> <br />1.Purpose: <br />This application contemplates several variances to construct a detached garage on the property. <br />2.MN§15.99 Application Deadline: <br />This application was submitted and considered to be complete on August 20, 2024. The 60-day <br />review timeline will expire on October 19, 2024. <br />3.Background: <br />There is no garage on the subject property; the owner proposes to remove the existing shed to <br />construct a new, detached garage. The applicant also proposes a larger more functional <br />5’x10’ front stoop where the existing stoop is approximately 4.5' x 4.5'. <br /> <br />The proposal requires the following variances: <br />Front yard setback variance to permit the stoop to be expanded 22 feet from the front where <br />50 feet is required; <br />Rear yard setback variance to allow a 5 foot setback for the garage where a 15 foot setback <br />is required; <br />Side street setback variance to the garage to be set 23.8 feet where a 50 foot setback is <br />required; <br />A side yard setback variance for the garage to be 5 feet from the lot line where a 10 foot <br />setback is permitted; <br />A variance from the 10-foot building-to-building setback to allow a 6.5 foot separation <br />between the home and the new garage; and <br />A hardcover variance to permit the changes to site resulting in a reduction from 42.5% to <br />39.3% where 35% is permitted. <br /> <br />The complete project summary and full variance analysis is included in the Planning Report <br />attached as Exhibit A. <br />4.Public Comment: <br />The neighbor to the south, the Minnetonka Center for the Arts, provided comments which are <br />attached as Exhibit H. <br />5.Staff Recommendation: <br />Staff recommends approval with conditions, as noted in the Planning Report. <br />6.Planning Commission Action Requested: <br />The Planning Commission should review the practical difficulties, if the Commission agrees with <br />the findings, Staff recommends the Commission consider a recommendation for approval. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />5
