The house is 13' from the south lot line, 8’ <br />from the north lot line, but 58' from the north lot line if the <br />adjacent commonly owned property is taken into account. Due to <br />the size of the property, hardcover was not a factor in the <br />application, and average setback was determined to not be a <br />problem. Staff had raised concerns about future septic needs. <br />The applicant had noted that due to ownership of the two parcels <br />on separate contracts for deed, he could not combine the two <br />properties until some future date. <br />Council directed staff to draft language regarding <br />conditions on methods and timing of septic system expansion <br />should it be needed in the future, and language for a possible <br />assessment appeal waiver to be incorporated as a requirement in <br />an approval resolution. <br />The applicant was sent a draft of an assessment appeal <br />waiver paragraph which he agrees to in principle, although staff <br />had suggested that perhaps he wait for the general appeal waiver <br />letter that is going to be sent to the Stubb's Pay neighborhood. <br />Since that general appeal waiver information has not been sent as <br />of this week, the applicant is requesting that Council go ahead <br />on the basis that applicant will agree to signing an assessment <br />appeal waiver for the reasonable share of the costs to serve his <br />property
