metropolitan council <br />Hears Park Centre, 230 E. 5th Street, St. Paul, Miaaasoca 33101 <br />612-291-6339 <br />RESOLUTION NO. 90-2 <br />RESOLUTION APPROVING REQUESTS FOR EXTENSION OF TIME <br />TO MEET REQUIREMENTS OF THE METROPOLITAN LAND PLANNING ACT <br />WHEREAS, on April 10, 1989, the Metropolitan Council transmitted to all <br />local governments in the region its annual statement of changes in <br />the metropolitan system policy plans, including the policy plans <br />for wastewater treatment and handling (sewers) and for <br />transportation adopted in 1988, pursuant to Minn. Stat. Sec. <br />A73.836; and <br />WHEREAS, the 1976 Metropolitan Land Planning Act (Minn. Scat. <*73.356) <br />stater that within nine months after receiving an amendment to a <br />metrc,^ jlltan system plan, each affected local governmental unit <br />shall review its comprehensive plan to determine if an amendment is <br />necessary to ensure continued conformity with metropolitan system <br />plans. If an amendment is necessary, the governmental unit shall <br />prepare the amendment and submit it to the council for review; and <br />WHEREAS, the law provides a procedure for granting extensions of the time <br />for fulfilling these requirements; and <br />WHEREAS, resolutions of the governing bodies of a number of local <br />governments, with a description of the activities previously <br />undertaken to meet the requirement, and the reasons necessitating <br />and Justifying the request have been received by the Council; and <br />WHEREAS, the Metropolitan Council has made a finding of exceptional <br />circumstances or undue hardship as required by Minn. Stat. Sec. <br />473.869, that justify the requests; <br />NOW, THEREFORE, BE IT RESOLVED, <br />that the Metropolitan Council hereby approves the following <br />requests for extensions to the time for fulfilling the requirement <br />to respond to the 1988 Metropolitan Systems Information Statements, <br />with the condition that approval of an extension shall not exempt <br />the community from submitting all information necessary to <br />determine the potential Impact of any plan amendment or project on <br />metropolitan systems plans. Whether or not an extension has been <br />granted, if the Council determines that a local plan amendment or <br />project submitted for review is inconsistent with the metropolitan <br />system plans, it may not receive Council approval or favorable <br />coiomenc.
