Briefly, the applicants are <br />proposing to rearrange tho lot line between their two homestead <br />parcels. Additionally, McDowell is requesting to split the <br />adjacent existing 6.6 acre parcel into two 3-acre lots. <br />The attached exhibits document the issues re^^rding access <br />to the proper-y. The existing private easement road access to <br />the Hayssen property and properties further south, is part.ally <br />owned by Mr. White to the west. White contends that the McDowe.^ 1 <br />vacant p»-operty and the Hayssen and Alt properties do not have <br />legal access across White's land to at to Bayside Road. <br />McDowell has title insurance guaranteein t'iose accesses. White <br />has agreed to allow Hayssen and Alt (new i.omes built in the last <br />2 years) to use the private road, but would deny the 6.6 acre <br />McDowell parcel any access. White would agree to grant McDowell <br />an easement driveway further ea,jt along Bayside Road. <br />Planning COBunission Recommendation - <br />Planning Commission discussed the merits of the subdivision <br />as proposed and made the following recjmmendal <br />1. On a vote of 5-0, recommended approval of the proposed <br />lot line rearrangement between Hayssen and McDowell's <br />propertie <br />2. On a vote of 3-2, Planning Commission approved Option A, <br />(Exhibit E of the January 11th memo) with the followlug <br />conditions: <br />*
