RESOLUTION OF THE CITY COUNCIL <br />X540 <br />\\k�SHO� <br />A RESOLUTION <br />APPROVING THE PLAT OF <br />MOONEY LAKE PRESERVE <br />FILE #15-373913786 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono (hereinafter "City Council") <br />has adopted subdivision and land development regulations for the orderly, economic and safe <br />development of land within the City; and <br />WHEREAS, on May 5, 2015 BPS Properties, LLC (hereinafter the "Developer") <br />submitted an application for approval of a Preliminary Plat for property located at 300 Sixth <br />Avenue North in the City of Orono and legally described in Exhibit A (attached); and <br />WHEREAS, the Orono Planning Commission held public hearings on the <br />proposed subdivision on May 18, 2015 and again on June 15, 2015 and voted 6 in favor, 0 against <br />to recommend approval of the Preliminary Plat as revised by the Developer; and <br />WHEREAS, the Orono City Council reviewed the application at its regular <br />meeting on July 13, 2015, and on July 27, 2015 granted approval for the Preliminary Plat per the <br />findings and conditions of Resolution No. 6526; and <br />WHEREAS, the Developer has agreed to comply with all conditions of Resolution <br />No. 6526 and has completed or has agreed to complete all other requirements of the platting <br />regulations of the City including: <br />1. Completion of all platting requirements and conditions of Preliminary Plat Resolution No. <br />6526. <br />2. Dedication on the plat of perimeter Drainage and Utility Easements as required in <br />Resolution No. 6526. <br />3. Designation and dedication on the plat of wetlands subject to City and other agency <br />jurisdiction, and execution of a declaration of covenants for the permanent flowage and <br />Page 1 of 5 <br />
