CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />f" <br />N O . <br />1. Council approval is based on the survey and plans submitted by the Owners and <br />annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments <br />to the approved plans which are not in conformity with City codes will require further <br />Planning Commission and City Council review. <br />2. Proposed overall hardcover levels shall conform to the Tier 1 standards. <br />3. The Owners shall keep debris off of the public roadways. The noise resulting from the <br />trucks and equipment moving the material in and around the site shall be minimized to the <br />extent possible. The grading project will be evaluated and monitored by the City Engineer, <br />Minnehaha Creek Watershed District and planning staff so as to minimize nuisances <br />during the project. <br />4. Compliance with all permitting requirements of the Minnehaha Creek Watershed District. <br />5. Compliance with ongoing recommendations of the City Engineer. <br />6. Authorities granted by this resolution run with the Property not with the Owners, but are <br />permissive only and must be exercised by obtaining permits and commencing construction <br />of said project within one year of the date of Council approval, or the approvals granted <br />by this Resolution will expire on that date (October 12, 2016). <br />7. An as -built survey will be required upon completion of the project prior to refund of the <br />administrative grading and building permit escrows. <br />8. Violation of or non-compliance with any of the terms and conditions of this resolution shall <br />constitute a violation of the zoning code, shall automatically terminate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />9. The undersigned Owners have read, understand and hereby agree to the terms of this <br />resolution and on behalf of the Owners and the Owners' heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the Property. <br />Page 5 of 7 <br />
