FINDINGS <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 6 5 4 7 <br />1. This application was reviewed as Zoning File number 15-3725. <br />2. The Property is located in the LR -113 One Family Lakeshore Residential Zoning <br />District which requires a minimum lot area of 1.0 acres and a minimum lot width of <br />140'. <br />3. The Planning Commission reviewed this application at a public hearing held on <br />September 21, 2015 and voted 6 for and 0 against on a motion to approve the <br />conditional use permit and variance. The Planning Commission finds that the <br />following factors support the granting of the request: <br />a. The Property has 1.53 acres in area (or 66,646 square feet). <br />b. The Property has approximately 320 feet of width at the OHWL. <br />c. The project is residential in scope and scale and is compliant with the zoning <br />code. <br />d. The Property is adequately served by police, fire, roads, and stormwater <br />management. <br />e. The Property is provided with an adequate water supply and sewage disposal <br />system; in the opinion of staff this criterion is met. <br />The proposed use is not expected to generate excessive demand for public <br />services at public cost. <br />g. Development of the Property for residential use is compatible and consistent <br />with the neighborhood and surrounding uses. <br />h. The proposed use is compatible with the character of buildings and site <br />improvements in the surrounding area. The proposed restoration of the slope <br />and prevention of future erosion is compatible with the existing and future use <br />of the properties. <br />i. The project is not anticipated to result in undesirable views or sustained activity <br />so as to disturb neighbors. The grading and sub -grade retaining walls within <br />the 75 -foot setback area will have no negative impact on surrounding lands. <br />The regraded areas will be hidden behind vegetative screening when viewed <br />from the lake. <br />Page 2 of 7 <br />
