RESOLUTION OF THE CITY COUNCIL <br />NO. 6 52 7 <br />A RESOLUTION GRANTING <br />SETBACK VARIANCES <br />FROM ORONO MUNICIPAL CODE <br />SECTIONS 78-420 <br />FILE NO. 15-3744 <br />WHEREAS, J Brunello LLC, a Minnesota Limited Liability Company, <br />(hereinafter the "Owner") is the owner of the property located at 190 Orono Orchard Road <br />South within the City of Orono (hereinafter "City") and legally described as: Lot 48, Orono <br />Orchards, according to the plat thereof, Hennepin County, Minnesota (hereinafter "the <br />Property"); and <br />WHEREAS, John Brunello, (hereinafter the "Applicant") on behalf of the <br />Owner has made application to the City for a variance from Orono City Code Section 78-420 <br />to permit construction of a new single family residence on the Property which has 1.5 acres <br />(67,235 square feet) in area and 120 feet in width where 2.0 acres (87,120 square feet) in are <br />and 200 feet of width is normally required; and <br />WHEREAS, the Applicant has made application to the City for a variance from <br />Orono City Code Section 78-420 to permit construction of a new single family residence on the <br />Property 30.5 feet from the south side street property line where a 50 foot setback is required; <br />and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br />held a public hearing on June 15, 2015, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />I. This application was reviewed as Zoning File #15-3744. <br />2. The Property is located in the RR -1 B One Family Lakeshore Residential Zoning District <br />which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. <br />3. The Planning Commission reviewed this application on June 15, 2015, the Planning <br />Commission voted 6 in favor and 0 opposed on a motion in favor of approval of the side <br />street setback, lot area and lot width variances; based on the following findings: <br />Page 1 of 4 <br />
