The Property contains 45,933 square feet in area and has a defined width of <br /> 140 feet. <br /> b. The Property has a unique shape and is located along a channel which <br /> extends to Forest Lake. Due to the nature of the lakeshore the Property is <br /> somewhat disconnected from the lake proper. <br /> c. The location of the Applicants' home is partially ahead of the average <br /> lakeshore setback line. There is no conforming location lakeward of the home <br /> to construct additions or improvements. <br /> d. The proposed screen porch and pergola will meet the 75-foot lake setback. <br /> e. The Property will conform to the hardcover limitations of a Tier 1 property. <br /> f. There are mature trees separating the Applicants' Property from their <br /> neighbors which will likely screen most of the views of the improvements. <br /> g. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> h. The Applicants have demonstrated that enforcing the provisions of the Zoning <br /> Ordinance deprives the Applicants of the reasonable use of their Property. <br /> i. The Applicants' proposed pergola and screen porch will not alter the essential <br /> character of the neighborhood and will result in minimal or no negative impact <br /> on adjacent properties. <br /> j. The Applicants' proposal to construct the pergola and screen porch ahead of <br /> the average lakeshore setback will not adversely impact lake views enjoyed <br /> from the adjacent homes. <br /> 4. On July 27, 2015, the City Council considered this application including the <br /> findings and recommendation of the Planning Commission, reports by City staff, <br /> comments by the Applicants and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variances would not adversely affect traffic conditions, light, air nor pose a <br /> fire hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the Applicants, but is necessary to alleviate a practical difficulty; <br /> Page 2 of 4 <br />
