The granting of the proposed variances will not in any way impair <br />health, safety, comfort or morals, or in any other respect be contrary to <br />the intent of this chapter. <br />The granting of the requested variances will not merely serve as a <br />convenience to the Owner, but is necessary to alleviate demonstrable <br />difficulty. <br />m. The variances to redevelopment of the Property will alleviate a <br />practical difficulty inherent to the Property and not created by the <br />Owner. <br />4. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, <br />comments by the Applicant and the public, and the effect of the proposed <br />variances on the health, safety and welfare of the community as well as the <br />impact on properties in the vicinity. <br />5. The City Council finds that the conditions existing on this Property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the Owner, but is necessary to alleviate a practical <br />difficulty; is necessary to preserve a substantial property right of the Owner; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants variances from Orono <br />Orono City Code Section 78-305 in order to construct a new residence on the Property <br />consisting of 37.45 feet of width and 0.2 acre in area where 2.0 acres in area and 200 feet in <br />width are required; and variances from Orono City Code Section 78-305 in order to construct <br />a new residence 12 feet from the rear, street lot line where a 50 foot setback is required; 7 <br />feet from the north side lot line and 10.3 feet from the south side lot line where 30 foot <br />setbacks are requried; subject to the conditions listed below: <br />1. Council approval is based on the survey and building plans submitted by the <br />Applicant and annotated by City staff, attached to this Resolution as Exhibits A & B. <br />Any amendments to these plans may require further Planning Commission and City <br />Council review. <br />Page 3 of 5 <br />
