CITY OF ORONO
RESOLUTION OF THE CITY COUNCIL
No. 6574
m. The granting of the application is necessary for the preservation and
enjoyment of a substantial property right of the Owner.
n. The granting of the proposed variances will not in any way impair
health, safety, comfort or morals, or in any other respect be contrary to
the intent of this chapter.
o. The granting of the requested variances will not merely serve as a
convenience to the Owner, but is necessary to alleviate demonstrable
difficulty.
p. The variances to redevelopment of the Property will alleviate a
practical difficulty inherent to the Property and not created by the
Owner.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the Applicant and the public, and the effect of the proposed
variances on the health, safety and welfare of the community as well as the
impact on properties in the vicinity.
5. The City Council finds that the conditions existing on this Property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the Owner, but is necessary to alleviate a practical
difficulty; is necessary to preserve a substantial property right of the Owner;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants variances from Orono
Orono City Code Section 78-420 in order to construct a new residence on the Property
consisting of 163 feet of width and 0.89 acre is area for the Orono Portion and 11 feet of
width and 0.15 acres in area for the Wayzata Portion where 2.0 acres in area and 200 feet in
width are required; subject to the conditions listed below:
1.
