. •■■■OBONtM <br />CityofOROISO <br />* RESOLUTION OF THE CITY COUNCIL <br />NO. ______ <br />C) The scope of the overall project in minimal and will result <br />in a negligible impact on the lake and wetlands. <br />D) in a report doted October 12, 1987, the City Engineer Glenn <br />Cook had the followino v^^onts: <br />i. Tbo pr:.4;>ooea olteitiLion will improve the sedimintation <br />capacity available and widlifo habitat. <br />ii. The proposed alteration would not appear to have any <br />long term adverse effects on Lake Minnetonka. <br />iii. The alteration will reduce the assimilative capacity <br />of the marsh slightly. <br />Based Oil L review of the necessary findings in approving the <br />alteration of a protected wetland, the Planning Commission made the <br />following findings: <br />1. The proposed alteration will not restrict the passage of flood <br />water or run-off. <br />2. The alteration will not peso a danger to life or property. <br />3. The proposal appears to be compatible with the City's desire to <br />preserve natural land forms, vegetation ana wetlands. <br />4. The alteration vx3 1 provide greatrr storage or retention of run <br />off as a result of the increase in depth. <br />5. The City Council finds that the conditions existing on this pro <br />perty are peculiar to it and do not apply generally to other property <br />in his zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a domon- <br />ctrable hardrhip or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />6. The City Council finds that granting a conditional use permit to <br />allow the dredging of the wetland will not be detrimental to the <br />health, safety or general welfare of the public, would not adversely <br />affect light, air no- peso a fire hazard or other danger to <br />neighboring properties, nor will it dopioclate surrounding property <br />values and that the p»*oposecl level of use of the property will bo in <br />keeping with the inton*: and objectives of the Zoning Code and <br />Comprehensive PJan of the City. <br />Page 2 of 4
