Canine Program Memo Dated 2/8/90 <br />ri-L ’ 12 <br />.* ■. • - - <br />ISSUE - Selection of a method to handle the canir <br />Council decide to continue with it in light <br />Standards requirements. <br />program should <br />the Fair Labor <br />INTRODUCTION - At the Council’s January 22, 1990 Council meeting <br />it was indicated that the staff was researching the issue related <br />to how feeding and care of the dog on off duty hours was treated <br />in light of Fair Labor Standards Act. This was because of recent <br />indications that Fair Labor Standards considered that to be work <br />time. Previously many communities had treated this either as a <br />person’s own time considering the dog a pet or was using a non <br />wage method to compensate a person for the care time. <br />In the initial conception of che program the City had looked at <br />care and feeding costs of about $500 and another additional <br />$1,000 as possible compensation to the Officer for time spent in <br />care and feeding. <br />DISUCSSION - As noted in Attachment A various communities handled <br />it in various ways. In addition there are a number of <br />communities whose method probably does not conform to Fair Labor <br />Standards Act. <br />The City has until the start of the program to decide whether it <br />desires to participate or not. <br />ALTERNATIVES <br />1. Have the Officer work the normal time periods and pay the care <br />and feeding time at over time rates. It is estimated that this <br />would be about $3,300 per year. <br />2. Have the Officer work full shifts but continue to grant <br />compensatory time to the Officer. Needed shifts would be made up <br />by use of the part time officer. It is anticipated that the cost <br />of this option would be between $0 if no make up time was <br />required to approximately $2,400 if a part time officer were used <br />to make up all the compensatory time. It is anticipated, as <br />noted, that this would probably about $1,400 which is about $400 <br />over the initial $1,000 anticipated. <br />3. Allow the Officer a half an hour off each day plus
