Since we have no record of a DNR <br />permit for this sand placement, this action constitutes a <br />misdemeanor according to Minnesota Statutes, Chapter 105 i7, and is <br />punishable by fines up to $700 and/or 90 days in jail. <br />in order to be in compliance with state rules, you have the <br />following alternatives for action: <br />1) P,.etain a sand blanket that is no more than 50-feet vide along <br />the shoreline (or one-half the lot width, whichever is less), <br />lO-feet waterward of the Lake Minneton.ca ordinary high water <br />mark (OHW) of ?:9.A' (NGVD, 1929), and 6-inches thick. <br />Voluntarily remove all sand thu- exceeds the above-referenred <br />dimensions. <br />2) Apply for an after-the-fact permit to retain the work you r. ve <br />completei. A set of permit application forms was left with you <br />on AugvisL 21, 1989. The minimum fee for an after-the-fact <br />permit application is $250 (doubled normal $75 minimum <br />application fee plus minimum $100 for field inspection costs). <br />You are further advised that compliance t*1th DNR rules does not <br />preclude compliance with c:.her authorities.
