AGREEMBMT AS TO F CONSTRUCTION AND IMPROVEMENTS <br />AGREEMENT made this day of , 1990, by <br />and between the City of Orono (hereinafter "City of Orono”) and <br />Janquelynn M. Kelly (hereinafter "Kelly"). <br />WITNESSETH : <br />WHEREAS, Kelly is ^he owner of certain land located at 2056 <br />Shaoywood Road, in the City of Orono, County of Hennepin, State of <br />Minnesota (hereinafter the "Land") and legally described as <br />follows: <br />Southerly one-half (S‘i) of Lot 7 and all of Lot <br />8, Gust S. Johnson's Addition, Hennepin County, <br />Minnesota. <br />WHEREAS, Kelly has constructed a deck on the Land, as shown <br />on the survey which is attached hereto, incorporated by reference <br />herein and labeled Exhibit "A"; and <br />WHEREAS, the deck violates the average lakeshore setback site <br />line requirement, as set forth in Orono City Ordin^n;e, Section <br />10.22, Subd. 1; and <br />WHEREAS, the parties hereto are desirous of resolving this <br />matter. <br />NOW, THEREFORE, in consideration of the covenants as set forth <br />below, the parties hereto agree as fellows: <br />1. The existing deck construction as shown on Exhibit "A" <br />shall remain in its present configuration without further <br />alteration and location on the Lund. <br />o
