Mabusth <br />February 5, 1990 <br />Page 2 <br />As for the encroachment in connection with the average <br />lakeshore setback line, Ms. Kelly has obtained the consents of the <br />adjoining land owners who are most affected by the area <br />configuration of her deck. The adjoining land owners consent to <br />the construction and placement of the deck now located on the <br />property, as shown on the revised survey. Moreover, Ms. Kelly will <br />propose to the City Council that she and the City of Orono enter <br />into an Agreement regarding future construction and improvements, <br />in a form much like the Agreement enclosed herein, which would <br />restrict future deck construction and improvements. The intent of <br />this Ag_-eement is to preserve the deck in its present form, while <br />restricting future construction, such as the placement of a <br />screened-in porch or three-season porch on the deck surface.
