.� o.� <br /> O , O CITY of ORONO <br /> ; <br /> � � ' �� � RESOLUTION OF THE CITY COUNCIL <br /> �� :�� � Gtiti nio. � ��� � 9 <br /> ��kESH�g'� <br /> WHEREAS, Metropolitan Council staff have advised the City that this property <br /> can be added to the MUSA through a minor amendment to the CMP. The amendment is exempt <br /> from the 60-day comment period by adjacent jurisdictions because it is less than 40 acres in area, <br /> it does not change any Metropolitan Growth Forecasts, and is further from adjacent jurisdictions <br /> than the City's standard notification distance; and <br /> WHEREAS, the property does meet the exceptions established by Metropolitan <br /> Council so that the property will not be counted against Orono's density calculations, because it <br /> was 1) developed prior to 1985; 2) has a failing septic system; and 3) there are no alternative <br /> locations on the property where a replacement septic system would be feasible; and <br /> WHEREAS, in light of the above noted facts the Orono Planning Commission <br /> pursuant to published and written notice held a public hearing on July 16, 2012 and on a vote of <br /> 6-0 recommended that the property at ?0 Orono Orchard Road South be added to the MUSA. <br /> WHEREAS, the Orono City Council on July 23, 2012 voted 5-0 to conditionally <br /> approve an amendment of the 2008-2030 Community Management Plan (CMP) to include 20 <br /> Orono Orchard Road North in the Metropolitan Urban Service Area subject to Metropolitan <br /> Council review and approval, and directed City staff to prepare such an amendment and submit it <br /> to the Metropolitan Council for review and approval; and <br /> WHEREAS, on July 26, 2012 documentation for the proposed amendment was <br /> submitted to the Metropolitan Council for review and approval; and <br /> WHEREAS, on August 13, 2012 the Metropolitan Council indicated to the City <br /> via letter that the 2008-2030 CMP Amendment to include 20 Orono Orchard Road North within <br /> the MUSA meets the Comprehensive Plan Amendment Administrative Review Guidelines <br /> adopted by Met Council on July 28, 2010. The proposed amendment does not affect official <br /> forecasts, or the City's ability to accommodate its share of the region's affordable housing need. <br /> Therefore, Met Council will waive further review and action, and the City may place this <br /> amendment into effect. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Orono hereby amends the 2008-2030 City of Orono Community Management Plan Part 4C, <br /> Comprehensive Sewer Policy Plan (CSPP) by incorporating into the MUSA the property at 20 <br /> Orono Orchard Road North described in attached Exhibit A, finding that: <br /> 1.
