Judd <br />Suite 550 Shelard Tower <br />600 South Highway 18 <br />Minneapolis, MN 55426-1203 <br />Dear Mr. Judd: <br />Thank you for your letter of January 17th reviewing your <br />clients' proposed use of the property identified as record Lot <br />19. The total area of the jointly owned 11 parcels is <br />approximately 1.7 acres. Our records reveal that the original <br />owner Mick Lord has neither executed special combination papers <br />nor the procedural lot area variance resolution for filing <br />against the subject property. <br />I would be happy to meet with you to discuss the necessary <br />applications, fees and schedule of meetings. Before I schedule <br />such a meeting, I must seek the opinion of the City Attorney <br />concerning the issue of the need for an area variance for your <br />clients' proposed day use recreation area. <br />Sect!' . 10.31, Subdivision 6 (F) Substandard - Buildable <br />Record Lot Inventory lists the only permitted use for substandard <br />Lot 19 as one-family seasonal recreational use or for a single <br />permitted seasonal dwelling. Section 10.31, Subdivision 3 (C) <br />requires a minimum of five_acres for day use_recrea t i on areas. <br />The code goes on to further state that if the number of users <br />exceeds 100, the minimum lot area must be increased to maintain <br />ratio of 1 acre per 20 users. Section 10.31, Subdivision 6 (E) <br />Conforming Record Lot Inventory lists seven properties permitted <br />only one-family permitted or conditional uses in the RS District. <br />In consideration of the text and the purpose (Section 1C.31, <br />Subdivision 1) of the RS District code, the City may not be <br />allowed to consider such a variance.
